With more and more people having an iPhone, so is the increase in demand for quality and fun applications for it. Is it possible for me to get my Flash game off 10 pages of websites that stole it?
I made a game called "The Adventures of John Jumper". I posted it on Newgrounds. CRAPLOADS of jackasses stole it and posted it on there websites. Is there any way I could get it off of those websites without copyright involved?
Here's what you need to do:
Without copyright? It'd be rather hard. Personally, I'd do it this way:
1) Write the site owner an e-mail (with read receipt) that says something like this:
"You may not know me, but you have my game ______ on your website. I only authorized NewGrounds to use it, but apparently you didn't see that (or chose to ignore it). So here's the friendly warning: remove it within 7 days, or I will have to notify your ISP. What happens then to your site is not my problem."
2) When you do notify their ISP, esp. if they are in the US, do it like this:
"Dear ISP,
I am writing you regarding a DMCA violation hosted on your server. The user at ______ (url) is hosting an UNAUTHORIZED copy of my game, which is exclusive ot NewGrounds (give URL). I have provided NewGrounds exclusive publish rights (give contract details).
I have a good faith belief that use of the copyrighted materials described above as allegedly infringing is not authorized by the copyright owner, its agent, or the law.
I swear, under penalty of perjury, that the information in the notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
As per DMCA provisions, I am notifying you of the allged violations. I have written the user on (date) but as of now have not received any response. I request you to deactivate the disputed content until their right to publish such content have been clarified.
If you require a written notice, please provide me a fax number or mailing address. My contact information is ______________. "
